Please read the terms of service ("Agreement") carefully and completely before using any services provided by Linkiipal, LLC.

By using the services on this platform and booking or reserving a listing rental or listing a listing for rent, You agree and accept all terms and conditions. If You do not agree to accept all terms and conditions, You are not authorized to use the services, website or platform.  The Company reserves the right to suspend or permanently block any User who chooses to violate these terms and conditions or for any other reason without prior notice.  The Company reserves the right to change or modify these terms and conditions at any time and without notice.

Interpretation and Definitions

INTERPRETATION

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

DEFINITIONS

For the purposes of these Terms of Use:

“Affiliate” means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50 percent or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

“Country” refers to: United States

“Content” refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.

“Device” means any device that can access the Service such as a computer, a cellphone or a digital tablet.

“Feedback” means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.

“Booking” or “Reservation” means a request by You to rent a listing through the platform.

“Promotions” refer to contests, sweepstakes or other promotions offered through the Service.

“Third-party Social Media Service” means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

“You” means the individual accessing or using the Service or Platform, or a business, or other legal entity on behalf of which such individual is accessing or using the Service or Platform, as applicable.

"Company" or "the Company" or "We", or "Us" or "Our" refers to Linkiipal, LLC.

"Services" or "Platform" or “Website” means software and applications offered by the Company accessible from URL: https://linkiipal.com.

“Terms” or “Terms of Service” or “Terms of Use” or "Policy" or “Agreement” means written guidelines that outline the practices and procedures that form the entire agreement between You and the Company regarding the use of services.

"Renter" or "Listing Renter" means any person or company who requests a reservation or booking to rent a listing on the Company platform.

"Owner" or "Listing Owner" means any person or company who lists a listing they own for rent on the Company platform.

"Listing" means any towable vehicle with wheels, axle, and a tow hitch with the intended use of carrying a load that can be towed behind/connected to an adequate vehicle equipped to tow.

“Tow” or “Operate” means any listing pulled behind any vehicle or to utilize, use, load, unload, tamper with or otherwise in any capacity.

“Hitch Type” or "Bumper Pull Hitch" or “Gooseneck Hitch” or “Fifth Wheel Hitch” or "Tow Hitch" or “Hitch” means a device (hitch) that is attached to the chassis of a vehicle used to pull a listing.

"Tow Vehicle" means any vehicle that has adequate load ratings and tow equipment, such as, hitch, ball, light plug socket, brake controller, and safety chain hooks to tow a bumper pull, fifth wheel or gooseneck listing.

"Light Plug Configuration" means the style of plug wired from the listing and requires the same style plug socket on the tow vehicle.

"7 Pin Plug" or "7 Pin" or "7 Blade" or "7 Way" or "7 Pole" or "RV Plug" means a round plug wired from the listing and requires a round plug socket on the tow vehicle. 

"4 Pin Plug" or "4 Pin" or "4 Pole" or "4 Pine Flat" or "4 Pole Flat" or "4 Flat" means a flat plug wired from the listing and requires a flat plug socket on the tow vehicle. 

"Weight Capacity" means the maximum amount of weight that can be loaded on a listing and excludes the empty weight of the listing.   

"GVWR" or "Gross Vehicle Weight Rating" means the maximum capable loaded weight including the weight of the listing and the load.

"Listing Length" means the usable space of a listing and does not include the tongue.

"Listing Dimensions" means the width and length of the listing as specified by the manufacture and may not be defined as exact measurements.

"Ball Size" means the size of the ball required on the hitch of the tow vehicle to pull a listing.

"Listing" means any page on the Company platform which displays a listing for rent.

“Rental” or “Rented” means the processing of a paid transaction on the Company platform for temporary use of the Owner’s non-motorized listing, accessory, or any add-on item for a specific period. 

"Rental Period" means the amount of time in which a listing is booked for rental from the Company platform.

"Rental by Day" or "Daily Rental" means a 24-hour rental period. 

"Rental by Week" or "Weekly Rental" means a 7-day rental period.

"Rental by Month" or "Monthly Rental" means a 30-day rental period.

“User Account” or “Account” or "User" means a unique account created for You to access our Service or parts of our Service.

"Rent Amount" means the base rate of the rental rate by day, week or month.

“Deposit Deduction Claim” means any claim filed with the Company to withhold part or all the deposit for damages, loss, or late return during the rental period.

“Insurance Eligibility” means all minimum requirements must be met for insurance coverage of the listing during the rental period.

“Insurance Available” or “Insurance Included” exemplifies that the listing in view may be eligible for insurance and the purchase of insurance by the Renter will be mandatory to process a booking request.

 

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, Owners, Renters and others who access or use the Service.

By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Service.

You represent that you are over the age of eighteen (18). The Company does not permit any use of the service for those under the age of eighteen (18).

The Company is a facilitator of Services and not a party to any booking or rental.  The Company is not a broker, agent, or partner to any User of the Services.  The Company has no actual control over the conduct of any User.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

User Accounts

When You create an account with Us, You must provide Us information that is accurate, complete, and always current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
You may not use as a username, the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

All user accounts must contain the user's legal first name in the “First Name” field and the user's legal last name in the “Last Name” field.  Only the first name and first letter of the last name will be publicly visible.  All user's must provide and maintain a current working phone number and email address in Your profile.  This information will not be publicly visible.  Contact information, full personal names and company names are prohibited from being listed in the profile bio.

Each User may only create one (1) Owner account and one (1) Renter account. 

Consent for Identity Verification

We may use third party identity verification services to verify your driver’s license, confirm your identity and to protect against fraud and abuse.  When you create an account, you will be asked to submit a valid driver’s license, along with an image of yourself (a selfie) so that we can be sure you are the person on your driver’s license. Our third party provider may use a combination of machine learning tools and optical scans to authenticate your driver’s license, and may use facial recognition technology to produce a unique biometric identifier based on your facial geometry that can be used to compare your selfie to the image on the driver’s license you provided to determine the likelihood that the images are a “match.”  We may collect identity verification information such as a photograph or scanned copy of a driver’s license, selfie, payment card, driver’s vehicle record, insurance information, or other forms of identification information. We may also use a third party to verify a driver’s record, and any information submitted to that third party is subject to their privacy policy. In addition, we may use a third party to verify that your selfie and driver’s license match. For this specific service, any information you submit to that third party is covered by their privacy policy.  Linkiipal does not receive the biometric identifier generated from the images.  It is generated and held by our third-party provider until we inform them that the biometric identifier is no longer needed for the purposes described in this paragraph, which will occur no later than three (3) years after your last interaction with us.  For identity verification and security purposes, Linkiipal will have access only to the selfie image and will receive only the results of the identity verification process.  Any use of your information is subject to the Linkiipal Privacy Policy.  Linkiipal does not possess, use, disclose or retain your biometric information for any other commercial purpose.  Our third-party provider processes this information on our behalf strictly in accordance with our contractual agreements for identity verification services.  BY CLICKING THE “ACCEPT” BUTTON, YOU AGREE THAT YOU (1) HAVE READ, UNDERSTOOD AND ACCEPTED NEIGHBOR’S LISTING’S TERMS OF USE AND PRIVACY POLICY; (2) HAVE READ, UNDERSTOOD AND ACCEPTED OUR THIRD PARTY’S PRIVACY POLICY; AND (3) RELEASE NEIGHBOR’S LISTING AND OUR THIRD PARTY PROVIDER FROM ANY CLAIMS RELATED TO YOUR BIOMETRIC DATA, PHOTO/VIDEO (INCLUDING AUDIO RECORDINGS).

Placing Bookings for Listings

By placing a booking to rent a listing through the Service, You warrant that You are legally capable of entering into binding contracts.  You agree to pay all fees shown on the booking checkout page.  When you place a booking on the platform, you agree to be bound by these terms, including the Cancellation Policy, and the terms set by the Listing Owner on the listing page.  When a booking is accepted, a contract (“Booking”) is formed between the Listing Renter and Listing Owner.  The Company is not a party to the booking.  The Company is only facilitating the Services. 

YOUR INFORMATION

If You wish to place a booking to rent a listing available on the Service, You will be asked to supply certain information relevant to Your Booking including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and a picture of Your driver license.
You represent and warrant that: (I) You have the legal right to use any credit or debit card(s) in connection with any Booking; and that (II) the information You supply to Us is true, correct and complete.

By submitting such information, You grant Us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Reservation.

MINIMUM REQUIREMENTS TO RENT A LISTING

For the safety of all users on the platform, Renters must meet these minimum requirements:
• Be a minimum of twenty-five (25) years of age.
• Possess a valid driver’s license to operate a motor vehicle in the United States.
• Create an account with complete and accurate information on the platform.
• Verify phone or email using a one-time password.
• Complete ID verification.
• Pay using a valid credit card in the Renter's name.
• Use a tow vehicle properly equipped for towing in compliance with local, state and federal safety standards. 
• Maintain compliance with Our “Prohibited Use of Rented Listings” Policy
• Agree to all Terms of Service, including the Cancellation and Privacy Policy

To process a booking, all Renters must complete ID verification.  A digital copy of the Renter's license may be visible to the Listing Owner upon accepting the booking for security reasons.  The Renter may be required to produce a valid driver license at the time of receiving the listing for additional identity verification.

BOOKING REFUSAL AND CANCELLATION

We reserve the right to refuse service or cancel Your booking at any time for certain reasons including but not limited to:
• Listing availability
• Minimum age not met
• Improper tow vehicle or equipment
• Invalid, suspended, or revoked license or no license
• Errors in the description or prices for Listings
• Errors in Your booking
• Errors in Your profile
• Minimum requirements to rent a listing not met
• Any violation of the Company policy
• Identity mismatch or unverified
• Harassment, inappropriate behavior, unprofessional or verbally abusive behavior
• Any violation of Our Terms of Use
• Any reason We deem appropriate
We reserve the right to refuse or cancel Your booking if fraud or an unauthorized or illegal transaction is suspected.

YOUR BOOKING CANCELLATION RIGHTS

Any Listing You rent can only be cancelled and refunded in accordance with these Terms and Conditions of Our Cancellation Policy.

CANCELLATIONS POLICY

• Cancel at least 72 hours prior to the start of your rental and receive a 75% refund.
• Cancel 48 - 72 hours prior to the start of your rental and receive a 50% refund.
• Cancel 24 - 48 hours prior to the start of your rental and receive a 25% refund.
• No refund for cancellations within 24 hours of the start of your rental.
• No refund for same day bookings.
• Platform fees are non-refundable after the booking is accepted.
• A no-show is the same as a Renter cancellation without notice.

All booking cancellations requested by the Renter must be processed by the Renter, from the Renter account by selecting the “Cancel Booking” button on the Booking Details page. A cancellation request from the Renter to the Company or to the Listing Owner by phone, text, voicemail, email, mail, web or app Contact-us page, live chat, support chat, conversation portal or any other means of communication will not cancel a booking under any circumstances.   

If part or all of the payment is refundable, we will reimburse You no later than 10 days from the day on which a refund is granted.  We will use the same means of payment as You used for placing the Booking.

BY CLICKING THE “ACCEPT” BUTTON WHEN CREATING A BOOKING OR REGISTERING FOR AN ACCOUNT, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD AND ACCEPTED LINKIIPAL'S LISTING’S TERMS OF USE CANCELLATION POLICY.

 

Availability, Errors, and Inaccuracies

We are constantly updating Our offerings of listings on the Service. The Listings available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding the listings on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Rate Policy

The Company reserves the right to allow Listing Owners to revise the listing rental rates, fees, and deposit amount at any time and without prior notice.  As an Owner, you are prohibited from any rate increase after a booking has been placed for the purpose of increasing your profit margin. 

The rental rates quoted may be revised by the Listing Owner subsequent to a Booking in the event of any occurrence affecting a change in the rental period, delivery distance, change of delivery location, change request of a different listing, change or addition of add-ons.

The rental rate displayed as “Per Day, Per Week, Per Month” on every listing page is a base rate and is not inclusive of all fees.  By selecting the “Rent” button, a breakdown of all fees will be displayed prior to entering information to request a booking.

Payments

All Rentals are subject to a rental fee, booking fee, deposit processing fee, insurance fee, tax, and other fees for optional add-ons. 
When You create a booking, Your credit card will be authorized, but the charge will not be captured until or unless the booking is accepted. 

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If the Company does not receive the required authorization, the Company will not be liable for any delay with Your Booking.

The Company accepts all major credit cards, Apple Pay, and Google Pay as payment and no other form of payment will be accepted.  The Company uses Stripe, a third-party payment processor. By using the Services offered by the Company, You understand and agree the Company is not responsible or liable for terms and conditions, limitations set by, or monetary action taken by Stripe. This includes, but is not limited to refunds, service fees, fraudulent charges or any other fees imposed by Stripe.   By using the Company Services, You agree to the Stripe’s terms and conditions.

Chargebacks

A chargeback occurs when the Renter disputes a charge on their credit card. In the event a chargeback is initiated, the Company will review to determine if the chargeback was warranted. If not, the Company will dispute the chargeback on behalf of the Company and the Listing Owner. The Company will require the cooperation of the Listing Owner for necessary details and documents.  If the Company were to lose a chargeback for any reason, the Listing Owner is not entitled to the payout, and the Company may reverse the Owner payout from the Owner’s bank account.  

Rental Fees

The Listing Owner is responsible for setting the desired daily, weekly, and monthly rental fees, accessory rental fees, cleaning fees, delivery fees, and any other fees relevant to the rental.  If the Owner accepts a booking, he or she must honor the rental price shown in the booking.  It is the obligation of the Listing Owner to manage the rental extensions and ensure the Renter pays for any additional rental days through the "Rental Extension" link within the Renter's account.  The Company will make a reasonable effort to charge the credit card on file to recover unpaid rental fees.  The Listing Owner agrees the Company will not be responsible for loss of unrecoverable and unpaid rental fees.

Early Return Refunds

Early returns are non-refundable unless the Listing Owner authorizes the refund and provides written consent to the Company.  The maximum refundable amount will not exceed 75 percent of the unused rental period.  There will be a 10 percent, twenty-dollar minimum, admin processing fee for all early return refunds that will be deducted from the refund amount.  Early return refunds will not be granted by the Company after the Listing Owner has already received their payout.  Booking fees, insurance fees, the deposit processing fee, and other fees and surcharges are non-refundable for early return refunds.

Deposits

The Listing Owner sets the deposit amount. If the owner charges a deposit, it will be indicated on the listing and booking details.  All deposits are charged at the time of booking.  If a booking is accepted, the deposit amount is charged.  The deposit or any portion of the deposit can be withheld if a listing is returned with damage or loss, or any rented accessory is not returned or is returned with damages.  Other reasons why a deposit could be withheld include, but are not limited to, late return of a rented listing.  If a listing is returned on time and without incident, the Listing Owner initiates the deposit refund when the rental is marked complete.  Deposit refunds can take at least three to five business days to reflect on the Renter's bank statement. 

Rental Period

The “Rental Period” starts and ends at the booking start and end date and time unless there is a mutual agreement between Owner and Renter to change the rental start and end time. 

Rental Extensions  

If the Renter cannot return the listing when it is due, the Renter must go to the Company web platform or mobile app and process a request for extension prior to the end of the rental period.   The Listing Owner may also process the extension request from the booking page.  Any verbal or written agreement to extend a rental outside of the Company platform will exclude insurance coverage and will not be supported by the Company in the collection of any rental fees or other fees or withholding of any deposit for damages, citations, tolls, or any other incident that arises during the extended period of the rental if the rental period was not paid for through the Company platform.  If the extension request is not processed through the platform by the Renter prior to the end of rental date, insurance will not apply to the rental.

If a rental extension is not submitted or accepted by the Renter by the end of the pre-paid rental period, or if it’s known the Renter will not be returning the listing on time, the Renter agrees the Company or Listing Owner has the Renter’s consent and authorization, without prior or additional approval, to authorize or capture payment on the Renter’s credit card through the platform.  If the Listing Owner sends an extension request to the Renter, the Renter will have the option to accept or dispute the extension request.  If the extension request is not immediately disputed or no action is taken by the Renter, the Company will review the extension request and take appropriate action by accepting or rejecting the extension request.  The Listing Owner will not have the ability to process an extension request if the Renter’s card is not saved on file within the Renter’s account.

If the rental extension imposes a conflict or overlap with a verifiable upcoming booking on the Company platform which was pre-existing at the time of the extension, and the Listing Owner has made the Renter aware of the conflict at the time of extension, the Renter may be responsible for a twenty-five dollar ($25) surcharge per day, in addition to the listed rent amount, starting at the time of the extension.  If the extension requires cancellation of a booking on the Company platform that conflicts with the rental extension, twenty percent (20%) of the surcharge will be payable to the Company for cancellation of refund fees incurred.

Non-Compliance of Rental Extension by Renter  

If the Renter intends to extend the rental, the Renter must process an extension request prior to the end of the rental period.  This will ensure the rental is covered by insurance (if applicable) and it will ensure the listing owner can secure payment for the rental.  If the rental is not extended by the end of the rental period, a new booking may be created at the listed daily, weekly, or monthly rate.

If the Renter has not extended the rental by the end rental date and time and there has been no attempt to process an extension request and the Listing Owner is unable to process the extension, this will be “Non-Compliance of Rental Extension by Renter”.  If there has been no communication from the Renter to indicate when a new booking will be created and the rental period has already ended, the Listing Owner reserves the right, using fair and reasonable discretion, to assess a twenty-five dollar ($25) per day non-compliance fee, in addition to rental and booking fees, payable to the Listing Owner.  This fee may be deducted from the Renter’s deposit or charged to the Renter’s credit card on file without prior authorization or consent from the Renter.  Payouts from additional charges will exclude a 3.5 percent admin fee.

The Listing Owner reserves the right to reject extension requests.  The Listing Owner reserves the right to terminate the rental and / or repossess the listing at any time for Non-Compliance of Rental Extension by Renter.

Non-compliance of this policy may be escalated to a criminal matter per the Embezzlement Policy at the discretion of the Listing Owner.

Change Listing Request 

The “Change Listing” request feature enables the Renter to switch the listing of an accepted booking for a different listing offered by the same Listing Owner.  This feature is only available if the Listing Owner has a different listing available and is willing to allow the change.  The Change Listing feature allows for any price difference to be charged or refunded.  If the listing cannot be changed, the rental does not qualify for a refund outside of the Cancellation Policy.  If an accepted booking is cancelled and a new booking is processed to change the listing, the first booking will be held to the fees outlined in the Cancellation Policy.

Booking Date Change  

A booking date change may be requested by the Renter from the booking details page within the Renter’s account.  Date change requests cannot be processed through communication with the Company or Listing Owner.  If a date change is necessary, the Renter must communicate their intentions to the listing owner and check availability prior to the start of the original booking date.  If the listing is unavailable for the requested date change, the Renter may cancel or request a different date for when the listing is available.  A booking date change request must be submitted by the Renter within seventy-two (72) hours after the original booking start date.  If the Renter does not show up for the original rental date and does not request a date change within seventy-two (72) hours of the original rental date, the rental will be cancelled or rejected and there will be no refund in accordance with the Cancellation Policy.

Prohibited Use of Rented Listings

A.  Any person(s) not named on the Rental Agreement shall not be allowed to operate or tow rented listing.
B.  No person under the age of twenty-five (25) shall be allowed to rent, tow or operate a rented listing.
C.  The manufacturers specified weight limits shall never be exceeded regardless of the contents being hauled.
D.  No rented listing shall ever be used in an unlawful manner.
E.  No person operating or towing a rented listing shall plead ignorance to any local, state, or federal law regarding the safe operation or use of the listing.
F.  The Renter is prohibited from towing a listing with any inadequate vehicle or a load on any listing that does not comply with the National Highway Traffic Safety Administration or the Department of Transportation standards.
G.  The Renter is prohibited from using any tow vehicle with improper towing equipment, such as, the improper size ball, the improper light plug connection, no or non-working brake controller or an improper tow hitch.
H.  The Renter is prohibited from switching a listing to a different towing vehicle after taking possession of the listing if the towing vehicle is not adequate to tow the listing.
I.  The Renter is prohibited from using any listing without first having full knowledge of how to operate it, load it, and knowledge of all weight specifications.
J.  The Renter is prohibited from parking illegally on streets or violating traffic laws.
K.  The Renter or any other driver is prohibited from operating or towing a listing while under the influence of alcohol, marijuana or any controlled substance that may impair his or her ability to drive.
L.  The Renter or driver is prohibited from leaving the scene of an accident without reporting such an accident to law enforcement.
M.  The Renter or driver is prohibited from using any cell phone, electronic device or any other activity that may cause a distraction while driving and operating or towing a listing.
N.  The Renter is prohibited from operating or towing any listing that requires a special license or permit to operate, tow or haul a load on any rented listing if the Renter does not hold the required, valid, license or permit.  The Renter is prohibited from renting, operating, or towing any listing on the platform unless he or she possesses a valid driver license legally issued by a local government within the country where the listing is being rented. The Renter is responsible for knowing the law pertaining to special licensing, permits and load limitations.
O.  The Renter is prohibited from performing any mechanical work on any rented listing without the consent of the Owner.
P.  The Renter is prohibited from maintaining possession or refusing to relinquish any rented listing when an Owner refuses to extend the rental.
Q.  The Renter is prohibited from maintaining possession or refusing to relinquish any rented listing when a rental has been terminated for any reason.
R.  The Renter is prohibited from loaning, giving, re-renting or letting another person use a rented listing who is not named as a driver or Renter on the reservation.

Fees Incurred by Renter

The Renter is responsible for paying for all fees, including but not limited to rental days, tolls, parking tickets, traffic violations, towing, impound, transport, repossession, damages, cleaning, late fees, loss, abandonment, non-returned accessories, etc. A 3.5 percent admin fee will be added to all fees charged by the Company.  If the Renter is delinquent for any period and fees are unpaid at the end of the paid rental period, the Renter agrees and accepts that the Company will charge the Renter's credit card without prior authorization to pay for applicable fees.  

Unpaid Fees

Unpaid fees will be subject to an additional thirty-dollar ($30) administration fee by the Company per incident or citation. Delinquent accounts will be sent to collections and will incur an additional 35 percent surcharge and may be reported to the credit bureaus. You acknowledge that You have no right to contest fees assessed for such charges in compliance with this policy. You agree to indemnify and hold the Company and the Listing Owner harmless of any actions, consequences or penalties associated with any activity or use while the listing is in Your possession.  If Your account is referred to a collection agency, Renter agrees to pay any collection fees or legal fees incurred by the Company or the Listing Owner in addition but not limited to any attorney fees or costs of collections.

Toll Fees

The Renter is responsible for paying all tolls during the rental period. If the Company or the Listing Owner receives a toll bill from a toll authority, the Company will charge the Renter. Renter agrees to pay the Company all toll fees assessed by the toll authority and an administration fee of $7.00 per toll transaction.  Each toll transaction will be identified on the payment receipt by the toll authority ticket ID number.  The Renter agrees and accepts that the Company will charge the Renter's credit card without prior authorization to pay for associated toll fees and a $7.00 admin fee per toll for tolls that were incurred during the rental period.  Any toll fees unrecoverable by the Company from the Renter will become the Listing Owner’s responsibility or the Listing Owner may defer the toll fees to the Renter via the Toll Authority’s leased vehicle option, if available.  The Listing Owner may be eligible to subscribe to the Company’s toll program to reduce the risk and liability of tolls.

Late Fees

No rental grace period will be offered to the Renter. If the listing is not returned by the return “due” date and time, an additional 24-hour rental amount will be withheld from the Renter's deposit unless an extension request has been submitted and pre-paid in advance.  If a rental extension request is not submitted by the Renter and there are late fees that exceed the deposit amount, the Renter agrees the Company has authorization to charge the late fee to Your credit card without prior authorization.  

Non-Use & Condition Acceptance

The Renter agrees that by booking the rental and taking possession of the listing, he or she is accepting the condition and usability of the listing and is entirely responsible for full payment of the rental and any additional fee. 

There will be no consideration of reimbursement for the inability to use the listing, regardless of the circumstance, by the Renter for any reason after the Renter has taken possession of the listing.  The Renter agrees that while using the Company platform and renting from listing Owners, the Company will not be held responsible or liable for the condition or usability of any rented listing.  

It is the responsibility of the Renter to inspect the listing prior to taking possession. Once the Renter takes possession of the listing, the Renter accepts the condition and usability.  The Renter and Owner should both take pictures of the listing at the time of rental.  If the Renter discovers a defect or any mechanical issue with any part of the listing; including but not limited to lights, brakes, tires suspension, electrical, durability or safety of the listing, the Renter must immediately notify the Listing Owner and the Company prior to taking possession of the listing.

Costs incurred for downtime due to mechanical, electrical, or structural failure during a rental, such as, hotel fees, meals, or any other cost will not be reimbursed under any circumstance.  

You agree to use the rented listing in a lawful manner.  You agree that during the use of any rented listing, You will abide by the specified weight limitations and will not overload any rented listing.  You agree not to haul hazardous materials or illegal substances that are prohibited by state or federal laws.  You agree to abide by all laws and always operate the listing in a safe manner.  

You agree to indemnify and hold the Company harmless of all liability as to the mechanical, structural, or electrical failure of any rented listing or for communication or miscommunication of any instruction or misrepresentation of any advertised or rented listing and its specifications, descriptions, or listing images listed on the Company platform or other advertised materials.

Damages

Any damage that occurs to the listing during the rental period is the full responsibility of the Renter, not the Owner or the Company. The Renter will be liable to pay for damages that cannot be proven to have existed prior to the rental.  The Renter is responsible for the damage regardless of any proof of repairs being completed.  It is the discretion of the Owner to choose who will repair damages.  All repairs should be completed by a professional with the necessary skills and certification to perform the work as required by local, state and federal safety standards, which may include the Listing Owner or a professional technician.  The Company or Insurance Provider may request proof of repairs for any damage reported.

The Renter shall keep the listing secure and maintain the rented listing during the rental at his or her own cost and expense. The Renter agrees to return the listing in the same condition as when it was received. 

The Renter shall pay the Owner full compensation for the replacement and/or repair of the listing or rented accessories which is not returned because it is lost or stolen or any part of the listing or accessory which is damaged and in need of repair to put it into the same condition it was in at the time of rental. Renter agrees the Owner is authorized to hold the Renter financially responsible for such loss or damage by not returning the full or partial amount of the deposit.

A deposit deduction claim is not insurance.  A Deposit Deduction Claim is a request to withhold part or all of the Renter’s deposit for damage or loss.  The Deposit Deduction Claim may include details regarding damage and loss that exceed the deposit amount.  Any information provided in a Deposit Deduction Claim may be used as evidence for a claim or to recover a loss.  A loss is defined as physical damage to a listing, missing or damaged rented accessories, or late return fees.  All Deposit Deduction Claims must be submitted by checking the "Deposit Deduction Claim," checkbox during the "End Rental" process.  

If a loss occurs, and the listing Owner does not withhold part or all of the deposit when closing out the rental, the loss may not be recoverable by the Company.  When claiming a loss of an accessory, the loss can only be reported if the accessory was included in the rental and paid for as an add-on during the booking process.  The Company will have no responsibility to recovery fees for any listing or accessory that is borrowed and not named as a listed rental or rented item in the booking.  

All deposit deduction claims must be filed immediately when the listing is returned by the renter.  If the Deposit Deduction Claim cannot be filed immediately at the end of the rental, You must immediately notify the company of damage or loss by sending an email or message, including details or photos of the loss, to the Company.  

All Deposit Deduction Claims must include all images that clearly identify damage or loss, a full description of the damage or loss, and any receipts or estimates for repairs or replacement parts.  If available, the claim should include a fair cost estimate for repair or replacement of parts and labor.  The Listing Owner may choose to do their own repairs.  Any images, descriptions, receipts, or dollar amounts of loss that are not stated in the original claim and reported later may be excluded from the claim.  Claims involving an accident or theft must include a police case report number.

A claim can only be filed once per rental.  Changes to claims after they have been submitted to the Company may be denied.  For a claim to be considered for deposit deduction, You must have uploaded pictures at the start of rental, uploaded pictures at the end of rental, and You or a representative must have been present with the renter at the start of rental and end of rental process.  If You or a representative were not present when the Renter received and returned the listing, the Company may deny Your Deposit Deduction Claim.  If damage or loss cannot be proven or if the Company using its reasonable judgment has any doubt that the Renter caused the damage or loss, the Company may deny Your Damage Deduction Claim.  

The company can only withhold up to the full amount of the deposit. For any damages that exceed the deposit amount, the Renter agrees the Company is authorized to charge Your credit card to collect those fees up to the full amount of the insurance deductible.  The Company makes no commitment or guarantees to the Listing Owner as to Our ability to recover fees that exceed the deposit amount.  

The Company will use its best judgement based on fair market value to evaluate the cost for replacements, repairs, and labor costs.  Repairs must be limited only to the affected part(s).  For example, if the Renter runs over a nail and causes one (1) tire blowout, the Renter is responsible for the cost to replace one (1) tire and not the other tires if they were not damaged.  Or, if there is minor cosmetic damage, such as scratch, the Renter is responsible for the cost to repair the scratch; the cost of a new paint job for the entire listing will be denied.   The Company will use reasonable judgement in determining what is wear and tear and what is damage.

Deposit Deduction Claim Dispute by Renter

If the Renter has an objection to the claim after it is filed but before it is closed, the Renter must use the “Contest Claim” link immediately upon receiving the email and text notification of the claim.  The SMS Deposit Deduction Claim notification will provide a link to the page where You can dispute the Deposit Deduction Claim.  The Deposit Deduction Claim dispute form can be accessed from the Renter’s account at any time prior to the claim being resolved.  You may dispute any part of the claim including the amount, damages, and you may submit your own photos, statement or any other evidence.  The Listing Owner and Listing Renter agree that when the Renter disputes a Deposit Deduction Claim, the Company makes the final decision for the outcome of the Claim including the amount of money withheld from the deposit.  If the Renter chooses not to dispute or contest the Deposit Deduction Claim until after the Company approves the claim, the Renter will have no right to dispute the claim unless the Company agrees to reopen the claim.

All Deposit Deduction Claims will usually be processed within 24-48 hours except if further investigation is needed.  The Listing Owner and Listing Renter agree that after a claim has been approved or rejected, the decision is final and cannot be reopened or appealed unless the Company elects to do so.  

After the claim has been closed, the Listing Renter and Listing Owner agree not to dispute the claim with each other or with the Company or the Renter's credit card company.  Harassment by the Listing Owner or the Listing Renter will be automatic grounds for permanent removal from the platform.  You agree to indemnify and hold the Company harmless from Our decision not to refund some or all of Your deposit due to damage, loss, or any dispute that may arise before, during or after a rental. 

The information You provide in a Deposit Deduction Claim must be factual and truthful and may be provided as evidence for an insurance claim or any legal authority that has a right to legally obtain such information.  If the Company believes there is evidence of deception or fraud by comparing start and end rental photos, photos from previous rentals, statements, or any other information received, the Company will take all appropriate and necessary action.

The Company reserves the right to permanently suspend account access to any Owner or Renter who files a false claim, any claim that exaggerates damages, any claim that includes damage that occurred prior to the rental, or for falsifying actual damage cost.

Listing Rental Insurance

The Company facilitates the offering of comprehensive and collision insurance coverage for all listing rentals that are eligible for coverage.  The Company is not a party to the insurance coverage, offering or policies. Insurance policies and rates are established by the insurance provider and are subject to change at any time and without notice.  Insurance claims will only be submitted if the minimum requirements are met and if exclusions do not apply.  Coverages, exclusions, and minimum requirements for insurance are established by the insurance company and its underwriters.  The Company may enforce insurance policies, but any argument, dispute, or disagreement that arises as a result of the denial of a claim, denial to submit a claim based on insurance policy, or discrepancy regarding insurance, coverage, non-coverage or payout amount, must be disputed directly with the insurance company or its underwriters.  By using this Service, You agree the Company will be held harmless for denial of coverage, ineligibility, non-insured rentals, software glitch, error due to incomplete listing or profile details, any complaint or claim with insured or non-insured rentals or incidents involving damages or injury, policy changes by the insurance provider that affect coverage, non-coverage on a listing page that indicate “Insurance Available”, and non-coverage due to a rental extension request not being submitted or accepted.  Insurance coverage is not guaranteed even if the listing states, “Insurance Available”.  Contents, tires, aftermarket accessories and logos or markings are not covered by insurance.  Insurance coverage is not provided in the states of Massachusetts, Hawaii, and Canada. 

MINIMUM REQUIREMENTS FOR INSURANCE

• You must complete ID verification.
• You must ensure Your profile is current and complete.
• You must ensure Your listing is current and complete.  
• Your listings must not exceed forty-five (45) feet in length.
• Your listing must not be more than twenty-five (25) years old.
• Your listing must not be custom-built, homemade, restored, or salvaged.
• The driver must be named on the booking and Certificate of Insurance. 

A listing that is eligible for insurance coverage will be indicated as such with the tag, “Insurance Available” on the listing page; however, this does not guarantee coverage.  Bookings may still be processed without insurance coverage when You have not met the minimum requirements to rent or when You have not provided complete and accurate information in Your profile and / or listing details.  

All Renter's must meet the minimum rental requirements to be eligible for insurance coverage.  The Company will not be liable for any rental processed without insurance coverage due to the Renter not meeting the minimum requirements set by the insurance provider.   The Company is not responsible for obtaining a copy of the Renter’s auto insurance policy.  You are strongly encouraged to request a copy or picture of the Renter’s auto insurance policy prior to the start of rental.

The insurance premium is paid for by the Renter at the time of booking.  Insurance is included by default.  Bookings that include insurance will provide an insurance certificate of insurance and payment receipt on the booking details page within every Owner and Renter account.  Insurance coverage is only effective during the rental period.  

If damage occurs during an insured rental, the Renter must pay for the cost of damages up to the full amount of the insurance deductible of $500.00 or the deductible amount stated in the certificate of insurance.  If the cost of damages is more than the deposit amount, the Renter agrees the Company has the right to charge the Renter’s credit card without prior authorization for damages that exceed the amount of the damage deposit to meet the deductible.  An admin fee of 3.5 percent of the additional charge will be added in addition to damage charges which will not exceed $500 in total. 

A listing cannot have double coverage by the same insurance provider. If the Listing Owner already has coverage with MBA Insurance, coverage will not be provided through the booking process even though the rental may be covered under a different policy held directly by the Listing Owner.

By listing your listing for rent on the Company platform, you agree to the terms set forth by the insurance policy / certificate of insurance, including all policies related to coverage and eligibility.  

You agree to hold the Company harmless in the event of any physical damage to Your listing, Your vehicle, property of a third party, bodily injury or death, accident, loss of time, loss of revenue or other liability or other incident involving any rental.  

Insurance Coverage Exclusions

Transportation to return your listing, compensation for loss of revenue, compensation for loss of rentals, tire damage, diminished value, contents within or on a listing, aftermarket accessories or equipment.  Insurance will not pay for "loss" due and confined to (a.) Wear and tear, freezing, mechanical or electrical breakdown. (b.) Blowouts, punctures or other road damage to tires.  The exclusions listed here are not inclusive and there may be additional exclusions not listed in the Company Terms of Use.  Coverage is determined by the insurance provider.  

All owners should have a working GPS tracking device equipped on the rented listing to assist with theft recovery.

NON-INSURED RENTALS

Any rental processed on the Company platform without insurance for any reason, including but not limited to, denial, software glitch, or incomplete information, will be Your responsibility to supply outside coverage or self-insure.  You agree to hold the Company harmless for all bookings generated without insurance coverage and for any physical damage to Your listing, Your vehicle, property of a 3rd party, bodily injury or death, accident, loss of time, loss of revenue or other liability or other incident involving any rental where insurance was not included or offered for any reason during Your rental.

Insurance Claims

The Company is not a party to any claim.  All insurance claims must be reported directly to the Company through the Deposit Deduction Claim process and the Linkiipal Claim Submission Form.  Each damage incident or occurrence must be filed under a separate claim.  All damage claims must follow the Deposit Deduction Claim Terms.  To file an insurance claim, You must provide all information, photos, and documents requested by the Company.  Damage will be determined through before rental and after rental photos.  An estimate alone will not serve as sufficient evidence to determine damages.  If You choose not to comply with the process and You do not provide the information requested, Your claim cannot be filed, or it may be denied.  All information provided through the Deposit Deduction Claim process may be used and provided to the insurance provider to be used in the insurance claim.  Claims will not be filed for damage that occurred during a non-insured rental period where there is no certificate of insurance for the rental period. Claims will not be filed for ineligible listings even if a certificate of insurance was generated in error.  There is coverage for loss of revenue or replacement of aftermarket insignia.  Lost, missing or stolen listings must be reported to law enforcement and the Company within 24 hours.  

LIABILITY

The Renter accepts liability while the listing is in the Renter's possession. The Renter agrees to provide Your own liability coverage and to hold the Owner and Company harmless during the rental period. 

The Listing Owner agrees to hold the Company harmless from any incident that arises during the rental. The company is not liable for any verbal or written agreement, statement, or other means of communication between Renter and Owner. 

The Renter and Owner understand and agree that the Company is not responsible for giving advice or reviewing communication and is not liable to correct miscommunication of Company policy or any other procedure or monitor the conduct of the Renter or Owner. The Company is not responsible for conducting background checks or ensuring any level of trust, credibility, or qualifying any Renter or Owner. 

By using the Company Services, You agree to indemnify and hold the Company harmless from damages, loss or any criminal or civil dispute arising from the course of doing business and utilizing the Company platform and services.

Termination of Rental

The Renter shall not pledge or encumber the rented listing in any way. The Owner may terminate the rental immediately upon the failure of the Renter to abide by the policies set forth in the rental terms.

Embezzlement

If a listing is not returned by the booking return “Due” date, and if there is no extension of the rental period or cooperation from the Renter, the Owner reserves the right to file a criminal complaint with local law enforcement.

Repossession

If the Renter fails to return the listing, does not cooperate in a scheduled pickup of the listing or requests an immediate unscheduled pick-up of the listing, a minimum of $7.00 per mile round trip repossession may be charged at the discretion of the Listing Owner.  If the listing was impounded, stolen, or the location of the listing was not immediately disclosed upon request by the Listing Owner or the Company during an attempt to repossess the listing, a minimum fee of $500 for repossession efforts may be imposed to the Renter and paid out to the Listing Owner. A 3.5 percent admin fee will be added.

Warranty

The Renter accepts the listing rental as-is without any warranty that such listing will provide the function or desired performance and intended use.  The Listing Owner or Company does not warrant the condition, quality, or performance of the listing.

Rental Agreement

The terms of this policy serve as a binding rental contract for all services offered through the Company platform.  The Company is not part of any verbal or written agreement between the Listing Owner and Listing Renter outside of this agreement.  

Communication

You agree while doing business through the Company platform, You will represent Yourself in a professional manor. Abusive, inappropriate language or threats will not be tolerated and will result in suspension from the platform. 

You are prohibited from attempting to circumvent the platform in any way.  For the safety, privacy, and best interests of the platform, You are prohibited from posting or messaging any direct means of contact prior to an accepted booking; including but not limited to:  posting or messaging a full or partial phone number, email address, social media link or name, website link or name, physical address, approximate address, approximate location, company name, company logo, brand or any other direct means of contact to a public listing page, profile page, profile image, listing page, listing image, listing image or message on the platform prior to the acceptance of a booking.  

If You violate this policy, Your message or posted content will be immediately deleted from public view or the intended User from viewing.  Violating this policy will be grounds for permanent suspension from the platform and / or enforcement of the Company Abuse of Services policy.  

Service Fee by Company

There is no fee to list Your listing on the Company platform. The Company takes a commission of 20 percent of the total rental amount (excluding deposit) for each rental transaction. The Company charges a booking fee of 10 percent with a $20 minimum and a 3 percent deposit processing fee to the renter. These fees enable the platform to operate and assist with advertising.  The “My Reservations” feature is exempt from the 20 percent deduction.

Listing Listing Guidelines

By engaging in the services offered by the company and listing a listing on the platform, You agree to read and comply with the Company policies and guidelines.  You agree to always conduct yourself in a professional manner.  You agree that You are responsible for the accuracy of content; including but not limited to Your listing description, listing weight, listing length, listing width, all listing specifications, listing condition, and rental commitments.  Any accepted booking that was cancelled due to inaccurate listing specifications may be subject to the “Booking Cancellation by Owner” policy without cause. 

All listings must include a description with a minimum of two hundred (200) characters, complete and accurate listing specifications, a minimum of 4 unique pictures of the listing, current city and state where the listing is located, and a fair and reasonable rental rate. 

Listing images must be real pictures of the actual listing being rented.  Listing description and images cannot display any direct contact information, company logo, company name, phone number, email, website, any other form of contact information or anything the Company deems inappropriate or unacceptable.  Manufacturer logos are permissible if the logo is not a direct means of contact and circumvention.  

The Company reserves the right to edit, change, rewrite, or alter any and all listing listing descriptions and images used in listings or advertising to comply with these terms.  Upon submitting images with your listing, you agree to grant the Company copyright privileges.

Listings with a salvage title are prohibited from being listed on the platform.  Custom built listings with DOT certification are acceptable to be listed on the platform.  
You may list Your listing for the purpose of offering rentals.  Listing a listing for the sole purpose of advertising a hauling service is prohibited.  A hauling service may be included in the listing only if it is combined with a rental transaction and added as an add-on in Your listing. Clear instructions must be stated in the listing description for adding the hauling service to the booking. 

Owner Rental Procedures

Listing Owners are required to review the "Getting Started" guide and the ”Rental Process Guide", which can be found in the Library within the Owner's Dashboard, upon establishing an account.  

Listing Owners have a responsibility to manage Your own bookings, rental extensions and answer questions from Renters or potential renters in a timely manner.  Owners who do not respond in a reasonable amount of time will receive automated and / or direct contact from the Company.  

All bookings must be accepted or rejected by the Listing Owner as soon as possible or within one (1) hour whenever possible.  If no action is taken to accept or reject a booking within twelve (12) hours, the booking will be subject to rejection by the Company and the listing and user account may be deactivated at any time at the discretion of the Company.  Listing Owners must accept seventy percent (70%) of bookings to maintain active listing status.

All messages must be answered by the Listing Owner as soon as possible or within one (1) hour whenever possible.  If messages are ignored or go unanswered by the Listing Owner, the listing and user account may be deactivated at any time at the discretion of the Company.  

The Listing Owner agrees that after accepting a booking, you must follow through with the rental and provide your contact information to the Renter.  If you choose to turn off the auto-s

This Privacy Policy discloses the privacy practices for Linkiipal, LLC (“Company”), www.Linkiipal.com website, the Linkiipal mobile application and various related services (together referred to as the "Site") and any website or app that may link to this Privacy Policy (the “Services”). Linkiipal, LLC, the provider of the Services (referred to as "us " or "we"), is committed to protecting your privacy online. Please read the information below to learn the following regarding your use of our Services. You acknowledge that this Privacy Policy is part of our Terms of Use, and by accessing or using our Services, you agree to be bound by all of its terms and conditions. If you do not agree to these terms, please do not access or use our Site or Services.

We collect four categories of personal information - personal information you give us; information automatically collected from your use of the Services; personal information from third-party sources; information from cookies.

Personal Information You Give Us


  • Account Data. When you register for an account with us, we may require certain personal information to open your account, such as your name, email address, and password. If you do not provide such required information, you will not be able to open an account with us.
  • Profile Data. We may also ask you to provide additional profile information to use certain features of the Services which may include your street addresses, phone numbers, driver’s license number, an image of your driver’s license, date of issuance and issuing country and/or state, profile photos, date of birth or other personally identifying information. Certain parts of your profile (like your profile photos and other biography data) are part of your public profile page and will be publicly visible to others.
  • Trailer Data. We collect information you provide in relation to a vehicle such as trailer listing details, vehicle identification number (VIN), availability dates, reviews, and uploaded trip photos.
  • Identity Verification Data. We may collect identity verification information such as a photograph or scanned copy of a driver’s license, a selfie, payment card, driver’s vehicle record, insurance information, or other forms of identification information. We may also use a third party to verify a driver’s record, and any information submitted to that third party is subject to their privacy policy. In addition, we may use a third party to verify that your selfie and driver’s license match. For this specific service, any information you submit to that third party is covered by their privacy policy.
  • Payment Data. We collect your digital payment details, bank account or payment card numbers, and transaction information in connection with an actual or potential transaction with us, which may be processed and stored by one or more third party payment service providers or digital payments companies. Storage of such information shall be subject to those third party payment service providers’ privacy policies.
  • Communications. When you communicate with us, including via phone, email, or any other method, or if you use the Services to communicate with other users, we collect information about your communication along with any information you choose to provide.
  • User Research. We may collect information you provide when you choose to participate in user research initiatives and/or community surveys. This may include demographic information if you choose to share it with us.

  • Usage Data. We may collect information about your use of the Site and the Services, such as bookings you have made, your login history, your searches, the pages or other content you view, how long you spent on a page or screen, sites from which you link or browse to in the Services, navigation paths between pages or screens, information about your activity on a page or screen, access time, duration of access, and other actions on the Services.
  • Location Data. When you use certain features of the Site or Services, we may collect information about your approximate location. When you activate our location sharing function on our app, it will share the precise location of that device with us. Most mobile devices allow you to control that functionality or disable the use of location services through your settings menu.
  • Booking Data. We collect transactional information related to the bookings you make through the Services, including the date and time of your booking, amounts charged, and other related booking details.
  • Device Data. We collect information about your computer or mobile device, such as its operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, unique device identifiers, or general location information such as city, state, or geographic area if available from your device.
  • Cookies and similar technology. When you access the Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, clear gifs, pixel tags,e-tags, “Flash cookies,” or other local storage provided by your browser or associated applications (collectively “Cookies”). For more detailed information on our use of these technologies, please see our policy on Cookies, Web Beacons, and Similar Technologies. At this time, we do not respond to browser ‘Do-Not-Track’ signals.

Personal Information We Collect From Third Parties


  • Third-party Registration Services. If you choose to login to our Site or Services through a third-party website or service (e.g., Facebook, Apple, or Google), the third-party service may send us information about you such as your registration and profile information from that service. The information we may receive varies by service and is controlled by the relevant service. By associating an account managed by a third party with your Linkiipal account and authorizing us to have access to this information, you agree that we may collect, store, and use this information in accordance with this Privacy Policy. We are not responsible for how those third parties use and share your information. Please refer to the privacy policies of the respective third-party website or service to understand how they use and share your personal information.
  • Driver’s License Verification. We may use third party identity verification services to verify your driver’s license, confirm your identity and to protect against fraud and abuse. When you create an account, you will be asked to submit a valid driver’s license, along with an image of yourself (a selfie) so that we can be sure you are the person on your driver’s license. Our third-party provider may use a combination of machine learning tools and optical scans to authenticate your driver’s license, and may use facial recognition technology to produce a unique biometric identifier based on your facial geometry that can be used to compare your selfie to the image on the driver’s license you provided to determine the likelihood that the images are a “match.”  For our third party’s privacy policy, please click here.

    Linkiipal does not receive the biometric identifier generated from the images. It is generated and held by our third-party provider until we inform them that the biometric identifier is no longer needed for the purposes described in this paragraph, which will occur no later than three (3) years after your last interaction with us. For identity verification and security purposes, Linkiipal will have access only to the selfie image and will receive only the results of the identity verification process.  Linkiipal does not possess, use, disclose or retain your biometric information for any other commercial purpose. Our third-party provider processes this information on our behalf strictly in accordance with our contractual agreements for identity verification services.
  • Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data, fraud detection information, or data from credit bureaus and other third-party data providers. We may combine the information about you that we receive from third-party sources with other information we have about you.

  • Usage of Cookies and Similar Tracking Tools. When you access the Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, clear gifs, pixel tags, e-tags, “flash cookies,” or other local storage provided by your browser or associated applications (collectively “Cookies”). Cookies are small pieces of text used to store information on web browsers. Cookies are used to store and receive identifiers and other information on computers, phones and other devices. Other technologies, including data that we may store on your web browser or device, identifiers associated with your device and other software, are used for similar purposes.   • When you use our Site or Services, we may store cookies on your device in order to facilitate and customize your use of our Site. A cookie is a small data text file, which a website stores on your computer's hard drive (if your web browser permits) that can later be retrieved to identify you to us. Our cookies store randomly assigned user identification numbers, the country where you are located, and your first name to welcome you back to our Site.   • For Research and Development. We may use your personal information to analyze and improve the Site and Services and to develop new products and services, including by studying our user demographics of the Services. We may also create aggregated, deidentified, or other anonymous data from your personal information. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Services and promote our business.
  • For Marketing and Advertising. We and our third party partners may collect and use your information for marketing and advertising purposes, including:
  • Direct marketing
  • Interest-based advertising with third party partners
  • Security and safety, including but not limited to, verifying your identity, authenticating the information you provided, resolving disputes, collecting fees, detecting and preventing fraud, conduct checks against databases and third party sources (including government public databases)
  • To Comply with Law. We use your personal information as we believe necessary or appropriate, in our sole discretion, to comply with applicable laws, lawful requests, and legal processes, such as to respond to subpoenas or requests from government authorities.
  • With Your Consent. We may, in some cases, ask for your consent to use your information. We may also use your information as described in this Privacy Policy. By using our Site and Services, you have agreed to the terms hereunder.

How We Disclose Your Information


  • With Your Consent. By creating a profile, using our Site or Services, posting a listing, and responding to a listing, you consent you consent to our use of your information to facilitate the Services.
  • Profiles, Listings, Public Information. Your listing on the Site or Services will always include some basic information about you, such as your user ID or name associated with your account, your public profile photo, the city where your trailer is located, your listing description, your calendar availability, transaction related information to allow our community to evaluate your reliability and responsiveness, and reviews or feedback about you. Your listing page may also include aggregate demand information (such as number of page views over a period of time) and information about your cancellations. The Site and Services may also display the approximate geographic pick-up location of your vehicle.

    By using the Site and Services, you agree to allow your public profile and public listing pages to be included in search engines, in which case your public profile and public listing pages may be indexed by search engines and may be published as search results.
  • Sharing Between Renters and Owners. We enable trailer owners to offer and share their trailers with other individuals. If you agree to a booking through the Services, we may provide your information to the other party in that transaction as reasonably necessary to facilitate the transaction. For example, we may provide your mobile phone number to facilitate communication, your driver's license information to confirm license validity and for identity verification, or your photograph to facilitate identification. We will also share the address of the trailer and, if applicable, the proposed delivery location with the other party. If you decide to text with the other party to any transaction to which you are a party, standard text message rates may apply.
  • Service Providers. We may share information with vendors and service providers who support the operation of the Site, Services and business and who need access to such information to carry out their work for us (including, for example, web hosting, payment processing, marketing, insurance, claims administration, trailer recovery, etc.). In some cases, the service provider may directly collect the information from you on our behalf. Any of your information provided to these service providers shall only be used as instructed by us and governed by our agreement with them. Any information you provide these third party services providers will be governed by your agreement with them.
  • Third Party Platforms Including Social Media. If you have enabled features or functionality that connect the Services to a third party platform or social media network (such as by logging in to the Services using your account with the third party, providing your API key or similar access token for the Services to a third party, or otherwise linking your Services account to a third party’s services), we may disclose to the third-party platform or social media network the personal information necessary to facilitate the connection or that you authorized us to share. We do not control the third party’s use of your personal information.
  • Business Advisors. We may disclose your personal information to our business advisors, such as lawyers, bankers, auditors, and insurers, where such disclosure necessary in the course of the professional services that they render to us.
  • Business Transfers. We may sell, transfer, or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a merger, consolidation, corporate divestiture, acquisition, reorganization, or sale of assets, or in the event of bankruptcy or dissolution.
  • Responding to Legal Requests, To Prevent Harm, To Protect Our Rights. We may disclose your personal information to courts, law enforcement, governmental or tax authorities, or third parties. We will make such disclosure to the extent we are required or permitted to do so by applicable law or where we consider such disclosure is reasonably necessary to comply with our legal obligations or legal process, to respond to claims asserted against us, to protect our rights, and for our security and safety. We may also disclose your information in response to valid legal requests relating to criminal investigations or alleged or suspected illegal activity or any other activity that may expose us, you, or any other user, or to protect the rights, property, or personal safety of us, our users, or others.

Your Preferences


  • Preferences. You can control the methods by which we may contact you about your account, your booking and listing activities, promotions, and announcements by emailing us at service@linkiipal.com.
  • Opting Out. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email. You may continue to receive service-related and other non-marketing emails. If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message or as described in the message.
  • Updating or Correcting Information. You can review, correct, update, and edit certain information that has been previously provided to us by you at any time by logging in to your account and reviewing your account settings and profile. You can also access or request a correction of your information by contacting us at service@linkiipal.com. For your protection, we may need to verify your identity before implementing your request.
  • Closing Your Account. If you wish to close your account and request deletion of your personal information, please send an email to service@linkiipal.com. Please note that we may be unable to delete information needed to comply with applicable laws, detect or prevent fraud, collect any fees owed, resolve disputes, assist with or process claims, troubleshoot problems, assist with any audits and investigations, to enforce our Terms of Use or other policies, and take other actions reasonably necessary, permitted, or required by applicable law. There may also be residual information that will remain within our databases and other records, which will not be removed.
  • Access. You can request a copy of your personal information pursuant to any information access rights that you may have under applicable laws by emailing us at service@linkiipal.com. We may request proof of identification or re-authentication to verify your access request.
  • Location Data. If you use our mobile application, you can disable the application’s access to the device’s location within the device’s settings.
  • Interest-based Advertising Choices. Your choices for limiting use of your personal information for interest-based advertising include:
    • Cookie preferences. This can be done through your web browser.
    • Blocking cookies in your browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.     • Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
    • Using privacy plug-ins or browsers. You can block sites from setting cookies for interest-based ads by using a browser with various privacy features and configuring them to block third party cookies/trackers.
    • Advertising industry opt-out tools. You can also use these opt-out options to limit use of your information for interest-based advertising by participating companies (but note we may work with companies that do not participate in these programs):

  • Third Party Platform and Social Media. If you choose to connect the Site or Services to a third party platform or social media network, such as by using the third party’s authentication service to log into your account on the Services, you may be able to control your settings through the third-party platform or social media network. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third party.

V. Security

We employ a number of technical, physical, and organizational measures designed to protect information against unauthorized access, destruction, or alteration while it is under our control. However, no method of transmitting or storing information can be 100% secure and we cannot guarantee the security of your personal information.

VI. Other Information

  • Cross Boarder Transfers. The Site and Services are controlled and operated from the United States. Your personal information may be used, stored, and processed in any country in which we have facilities or in which we engage service providers. These locations may be outside of your state, province, or country of residence, and may have different and/or less protective data protection rules than those of your state, province, or country. As a result, this information may be subject to access requests from governments, courts, regulatory agencies, security authorities, or law enforcement in those jurisdictions according to the laws in those jurisdictions.
  • Sensitive Information. We ask that you not send us, and you not disclose, any sensitive information (e.g., Social Security numbers, passport information, information related to racial or ethnic origin, or health) on or through the Site or Services or otherwise to us unless specifically requested.
  • Minors. The Site and Services are not intended for anyone under the age of 18 and we do not knowingly collect personal information from users under the age of 18. If a minor under the age of 18 has already provided us with personal information, his or her parent or guardian may contact us to request that we delete it.
  • Third Party Privacy Practices. This Privacy Policy addresses only the use and disclosure of information collected by us. This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any site or service to which the Site or Services may link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates. If you disclose your information to others, or if you are directed to a third-party website, their privacy notices and practices will apply.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of sources for the personal information we collected about you.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Request a Correction

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us through our Site.

Only you or a person registered with the state where you reside that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12- month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Non-Discrimination

We will not discriminate against you for exercising any of your rights. Unless permitted by the applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
